Terms & Conditions for IGA Rewards Program

Effective Date: 28th April 2025

These terms and conditions apply to your participation in the IGA REWARDS Program (Program) and use of the Program website (at https://igarewards.com.au) (Site) and IGA Rewards App (App). In this document, when we say we, us, our (etc.) we are referring to Metcash Trading Limited ACN 112 073 480. When we say you, your (etc.), we mean the individual who is a member of the Program.

Your agreement with us

We own and operate the Program and the Site. Your registration for, or participation in, the Program constitutes acceptance of these terms and conditions. We may vary the terms and conditions of the Program from time to time and the current version of the terms and conditions will always be available on the Site and in the App. We will give you reasonable notice (including by posting on the Site and in the App and/or by email) of any changes to these terms and conditions.  If you do not accept changes to the terms and conditions you can terminate your membership by contacting us (see “Leaving the Program” below). If the variation relates only to IGA Cash Back as part of the Program (see below) you may as an alternative close your digital Visa card (or alternative digital payment card connected with the Program) issued to you as part of the Program (Digital IGA Rewards Visa Card) (see “Additional terms and conditions applicable to the Digital IGA Rewards Visa Card” below). If you continue to participate in the Program that will constitute acceptance of the updated terms and conditions.

Your privacy is important to us

This document should be read in conjunction with the IGA Rewards privacy policy (https://igarewards.com.au/privacy).  If you are a member of both IGA Rewards and another loyalty program run by your independent IGA retailer but there is a single Membership Card used for both programs, then this document should also be read in conjunction with the privacy policy of that retailer and their loyalty program.

How to get started

Membership of the Program is free. In order to join the Program you must meet the eligibility requirements (see further under “Your and our responsibilities” below). To join you will need to register an account either: i. online at the Site; or ii. via the App. If you do not provide the information requested in the registration process, you may not be able to fully participate in the Program. As part of the registration you will need to:

  • provide a valid email address; and
  • provide the unique identifier printed on your physical IGA Rewards membership card (if you have been provided a physical card), or request that a digital IGA Rewards membership card be generated. References to a ‘Membership Card’ in these Terms are to the physical or digital membership card issued in connection with the Program.

More information about how to register your details (and Membership Card, if required) to participate in the Program can be found on the Site or in the App.

The Program is a loyalty program through which we provide member offers, deals and promotions (including third party offers, deals and promotions), targeted communications, the opportunity to participate in competitions and prize draws and the opportunity to participate in the IGA Cash Back program. The Program is reliant on electronic communications. By agreeing to participate in the Program you agree to receive electronic communications about the Program, the products and services offered through the Program, details of promotions and other benefits. If we determine that your email address is not valid, or if you unsubscribe from receiving future electronic communications about the Program or offers provided under the Program, you may not be able to receive some or all of the Program benefits (for example, you will no longer receive automatic entry into Program prize draws) and we may suspend or terminate your participation in the Program in whole or in part. Once you are a registered Program member you will have access to all the current benefits (see “Program Member Offers and Rewards” below) provided, in respect of IGA Cash Back, you have registered or logged in via the App. Your eligibility to receive Program benefits may be reduced or removed if you do not complete all of the information requested at registration.

Third Party Programs

If you have registered with an existing third party loyalty program (i.e. a loyalty program that is not operated by us) through an IGA Store (Third Party Program), you should check with that store (or the Third Party Program provider) if you have any questions about the Third Party Program. Your enrolment in a Third Party Program is an agreement between you and the provider of the Third Party Program. You should be aware that we are not a party to that agreement and do not take any responsibility for the provision of any Third Party Program benefits or the conduct of the Third Party Program more generally.

Your and our responsibilities

Any Membership Card issued to you remains our property. You are responsible for its safekeeping, and for the security of your Program account. To be eligible for a Program account you must:

  • be a resident of Australia;
  • be aged 18 years or over;
  • use your real full name and only provide accurate information to us in relation to the Program;
  • only maintain one Program account at any given time; and
  • have full power and authority to register for the Program and accept these terms and conditions.

You must give us accurate information about yourself (including as part of the registration process) and update your account online with any changes to that information. You must not transfer your Program account to another person or allow anyone else to use or receive the benefit of use of your Program account. You must not use your Membership Card, the Site, the App, any Digital IGA Rewards Visa Card issued to you, or any Program benefits we provide to you in any unauthorised or illegal manner. Our responsibility is to provide the Program in accordance with these terms and conditions, as updated from time to time in accordance with these terms and conditions. We are not responsible if you are unable to access or receive Program benefits as a result of your failure to comply with these terms and conditions, including a failure to provide accurate details or update your details in your account. We may (a) decline to register you for the Program and/or issue you a Membership Card, or (b) where we reasonably believe it is necessary to protect your or our interests, withdraw, suspend or cancel your Program accounts and/or Membership Card, in whatever form, and remove you from the Program or remove Program benefits (including by declining to issue a Digital IGA Rewards Visa Card) at any time if we reasonably believe that you:

  • are abusing or attempting to abuse the Program;
  • have materially breached these terms and conditions or the terms and conditions of any Program offers or benefits; or
  • are involved in any behaviour relating to our Program that involves theft, fraud, misconduct, abusive, offensive or other inappropriate behaviour, or the supply of false or misleading information.

The Program is only for personal and consumer use. The Program cannot be used for any business transaction or purpose.

You are solely responsible for the use of your account and for use by persons who access your account with your permission or by your failure to safeguard your login and password details or your mobile access to the App, including for any other person who uses your login and password details. You agree to notify us immediately using the Contact Us form on the Site or the App, by email to support@IGARewards.com.au or by calling the IGA Rewards Support team between 9:00 am – 5:00 pm Australian Eastern Time from Monday to Friday on 1800 018 384, if you become aware that your login or password details may have been compromised or if you believe any unauthorised person has accessed your account.

Program member offers and rewards

The purpose of the Program is to reward your loyalty to IGA retailers and provide you with member deals and benefits, as well as to enable us, IGA retailers, participating suppliers and other Program partners to gain insights into shopper trends, store and marketing campaign performance and other aspects of customer behaviour and retail performance. This will enable us and IGA retailers to provide you with relevant offers and enhance your experience as a valued IGA customer. Benefits of participation in the Program include:

  • ability to earn and redeem IGA Cash through the IGA Cash Back program;
  • in-store member deals;
  • access to third party offers for products and services;
  • targeted marketing communications in relation to the Program and the offers and deals provided under the Program; and
  • automatic electronic prize draw entry for promotions at participating IGA retailers.

You must present your Membership Card at the checkout in participating IGA stores to take advantage of any “in-store” benefits and follow the directions provided in member communications and offers to access other Program benefits. Membership Cards do not have any monetary value or accumulate points as part of the Program, and member benefits are not transferable or exchangeable for cash, except as provided under the IGA Cash Back program.

Excluded Products

Certain products, including tobacco and tobacco-related products, lottery products, stamps and gift cards do not qualify for Program discounts and savings, and will not be included in the calculation of qualifying spend or otherwise recognised for the purposes of automatic electronic prize draw entries or other offers. Other products may be added to the above list of excluded products at our discretion. Lists of excluded products will be posted on the Site at https://igarewards.com.au/exclusions. Changes to the list of excluded products will be emailed to you in advance of the implementation of the change consistent with the process used to inform you of material changes to relevant terms and conditions.

IGA Cash Back

The IGA Cash Back program allows members to earn IGA Cash by purchasing products on which an IGA Cash Back offer has been advertised to them (IGA Cash Back Products) in-store or online (for purchases made via the IGA Shop Online website – https://www.igashop.com.au/ – only) at participating IGA Rewards stores during the relevant advertised period. To be able to redeem IGA Cash, you must download the IGA Rewards App and:

  • if you are not already registered as a member, complete the registration information required by the App; or
  • if you have already registered as a member via the Site, log in to the App.

When an IGA Cash Back Product is purchased during the relevant promotional period at a participating IGA Rewards store, and:

  • your Membership Card is scanned at the time of purchase; or
  • your purchase is via IGA Shop Online (https://www.igashop.com.au/) and your email address for the IGA Shop Online transaction is the same as your email address for the Program,

we will credit the advertised IGA Cash Back amount as IGA Cash to your digital wallet within your IGA Rewards account. Transactions are intended to be processed in real-time to calculate and apply IGA Cash Back rewards, but there may on occasions be a delay in transmission of the transactions.

Once you have accumulated the minimum threshold of $20 IGA Cash in your digital wallet within your IGA Rewards account, you will unlock access to your IGA Cash. IGA Cash unlocks in increments of $20. IGA Cash unlocks for your use within 48 hours of reaching each $20 increment. You will be invited to download a Digital IGA Rewards Visa Card and you can access your IGA Cash by downloading the Digital IGA Rewards Visa Card to your digital wallet. The Digital IGA Rewards Visa Card will be loaded with an amount reflecting the value of your accumulated IGA Cash available for use from time to time. The maximum value which can be accumulated on your Digital IGA Rewards Visa Card at any one time is $4,999. If you download a Digital IGA Rewards Visa Card before you have reached the $20 minimum threshold, you will not be able to use it until you have reached the minimum threshold of $20 IGA Cash and the IGA Cash has ‘unlocked’ as above.

The value on your Digital IGA Rewards Visa Card can be redeemed only against the purchase of eligible products at IGA retailers participating in the Program, by presenting the Digital IGA Rewards Visa Card at the point of sale. Eligible products for redemption are all products other than tobacco and tobacco-related products, lottery products, stamps and gift cards. We may change the eligible products for redemption in our discretion from time to time, and such changes will be emailed to you in advance of the implementation of the change consistent with the process used to inform you of material changes to relevant terms and conditions.

We may from time to time provide other redemption opportunities by giving notice to you.

All transaction data and IGA Cash Back earning and redemption calculations are subject to verification.

If you return a product on which you earned IGA Cash Back, the value of IGA Cash Back in respect of that refunded transaction will be deducted from you IGA Rewards account and the relevant IGA retailer may require the original receipt for this purpose.

IGA Cash Back offers are determined by us in our discretion and may vary from time to time, from store to store and from member to member. Availability of IGA Cash Back offers depends on stock availability at IGA stores participating in the Program. Additional terms and conditions may apply to particular IGA Cash Back offers (such as limits on purchase quantities). No rainchecks will be given for out of stock products the subject of IGA Cash Back offers. See in-store or check the App for details on particular offers.

The IGA Cash Back program, including redemption via the Digital IGA Rewards Visa Card, is only available in IGA stores participating in the Program, which are listed from time to time on the Site at igarewards.com.au/page/cashback-participating-stores and on the App. No Foodland IGA stores or IGA stores in Tasmania participate in the Program.

Additional terms and conditions applicable to the Digital IGA Rewards Visa Card

These additional terms and conditions applicable to the Digital IGA Rewards Visa Card apply if you choose to register or login via the App.

In these additional terms and conditions applicable to the Digital IGA Rewards Visa Card, the following capitalised words have the following meanings:

  • Acceptance Brand means the symbols Visa uses at merchants and ATMs to inform Cardholders their Visa card can be used to make purchases or cash withdrawals.
  • Account means your IGA Rewards account, including your Digital IGA Rewards Visa Card downloaded in your account, accessible via the App.
  • Available Balance or Available Funds means the Australian dollar value that is available in your Account at a particular point in time which you can view by using the App and which you can utilise by using the Digital IGA Rewards Visa Card, subject to these terms and conditions.
  • Cardholder means you, in respect of any Digital IGA Rewards Visa Card issued to you.
  • Chargeback means the process established by Visa in which a Cardholder challenges a transaction made via their Digital IGA Rewards Visa Card.
  • Device means any equipment (electronic or otherwise), or artefact designed to be used to access your Digital IGA Rewards Visa Card.
  • Freeze means an action initiated by us or by a Cardholder which results in all existing and future transactions on the Digital IGA Rewards Visa Card being suspended pending investigation and/or instructions to Unfreeze.
  • Merchant means an authorised vendor who is able to accept and process a Visa Prepaid Card and who is an IGA retailer participating in the Program, or who we have approved to accept and process Digital IGA Rewards Visa Cards in connection with the Program.
  • PIN means personal identification number being the set of digits used to protect access to your Digital IGA Rewards Visa Card and which is created by you.
  • Unauthorised Transaction means a transaction which you have not authorised, and which has been made without your knowledge and consent.
  • Unfreeze means the releasing of the Freeze either at a conclusion of an investigation by us or on instructions of the Cardholder.
  • Visa means Visa Worldwide PTE Ltd.
  • Visa Prepaid Card means authorised physical or digital cards with the Visa Acceptance Brand or markings which has a specific loaded value on the card.

When you are issued with a Digital IGA Rewards Visa Card you will receive a digital card issued via the App. A Digital IGA Rewards Visa Card is a Visa Prepaid Card issued in accordance with these terms and conditions. You can access Available Funds in your Account to make payments at Merchants in accordance with these terms and conditions.

You can view your Available Balance at any time by using the App.

There are default limits that apply to an individual when using the Account and Digital IGA Rewards Visa Card:

Maximum available balance $4,999
Minimum balance $0 ($20 is the balance to ‘unlock’ the Digital IGA Rewards Visa Card for spending)
Maximum single Digital IGA Rewards Visa Card transaction Up to $4,999
Maximum Digital IGA Rewards Visa Card spend per day $4,999

From time to time, we may adjust the above limits to protect your, our or Visa’s interests. We will give you reasonable notice of any adjustment of the limits through the App and/or by email.

We or Visa may block certain merchants, such as identified high-risk merchants, or other merchants and merchant category codes from time to time, acting reasonably. A list of blocked merchants or merchant category codes is available upon request.

If you use your Digital IGA Rewards Visa Card for a transaction where the merchant or merchant category code is blocked, the transaction will be declined. Your Account will not be debited for the value of the declined transaction.

Within Australia you can make contactless transactions using your Digital IGA Rewards Visa Card without entering your PIN. Contactless limits may vary. As with any transaction, please make sure you check the amount is correct on the terminal before authorising a contactless transaction.

We will deduct the amount of any transaction using your Digital IGA Rewards Visa Card from your Available Balance. You cannot stop payment on a transaction after it has been completed. For mistaken or disputed payments please see further terms and conditions below.

Sometimes a transaction cannot be processed due to reasons outside of our control, including where there are network issues which may affect the relevant payment terminal. We are not responsible where a transaction authorisation is declined for any reason, except to the extent caused by our negligence, fraud or wilful misconduct (or that of our employees or agents).

Your Digital IGA Rewards Visa Card cannot be used for transactions overseas or in foreign currencies.

It is important that you keep your Digital IGA Rewards Visa Card information and PIN and any passcode secure. This means (without limitation) that you must not write down the PIN on something you carry with the Digital IGA Rewards Visa Card or share your PIN with any other person. You must not, without proper cause, disclose the Digital IGA Rewards Visa Card number to any person.

If you have lost your Digital IGA Rewards Visa Card or it has been compromised, then, to avoid continued unauthorised use, you must Freeze the Digital IGA Rewards Visa Card using the App and immediately report your Digital IGA Rewards Visa Card lost or stolen by emailing the IGA Rewards Support team at support@IGARewards.com.au or by calling the IGA Rewards Support team between 9:00 am – 5:00 pm Australian Eastern Time from Monday to Friday on 1800 018 384, and you may request a new Digital IGA Rewards Visa Card.

Where you think a transaction is an Unauthorised Transaction or is otherwise incorrect, please contact the IGA Rewards Support team immediately via the App and provide as much information as you can about the relevant transaction so we can investigate further.

There are specific circumstances and time frames where we can claim a refund in connection with a disputed transaction. This means that our ability to investigate a disputed transaction may be limited to the time frames imposed by Visa so it is important to let us know as soon as possible after you become aware of a disputed transaction.

If you have a problem with a purchase made with your Digital IGA Rewards Visa Card the first step is to contact the Merchant you made the purchase from.

If you cannot resolve the matter with the Merchant, contact the IGA Rewards Support team about the disputed transaction via the App.

You will not be responsible for Unauthorised Transactions:

  • that occur before your Digital IGA Rewards Visa Card is issued to you;
  • that occur after you have Frozen your Digital IGA Rewards Visa Card, and while it remains Frozen, or after you have cancelled your Digital IGA Rewards Visa Card; or
  • where you did not contribute to the Unauthorised Transaction.

We may consider that you have contributed to an Unauthorised Transaction where:

  • you have not kept your Digital IGA Rewards Visa Card or PIN reasonably secure;
  • there was an unreasonable delay in Freezing or cancelling your Digital IGA Rewards Visa Card where you believed it was lost, stolen or otherwise compromised; or
  • there was an unreasonable delay in reporting any unauthorised or mistaken payments.

You can view your transaction history in the App at any time. We take security very seriously but please regularly check it to make sure there is nothing unusual such as:

  • transactions you don’t recognise;
  • transactions you did not authorise;
  • transactions where you never received the relevant goods or services;
  • transactions where the purchase price differs from the purchase amount; or
  • circumstances where you think a transaction may have been duplicated.

We may Freeze or cancel the Digital IGA Rewards Visa Card where we have concerns about its security or for the purpose of protecting your Available Balance where we suspect the Digital IGA Rewards Visa Card has been compromised, and the next paragraph does not apply. If this happens, we will let you know as soon as possible, and you may contact us to request a new card (see above on how to contact us).

You can close your Digital IGA Rewards Visa Card at any time by emailing the IGA Rewards Support team at support@IGARewards.com.au or by calling the IGA Rewards Support team between 9:00 am – 5:00 pm Australian Eastern Time from Monday to Friday on 1800 018 384. We may need to call you to verify your identity as the Account holder. We will not be able to process your request until we are reasonably satisfied of your identity.

We cannot close the Digital IGA Rewards Visa Card immediately as we need to wait for all payments and transactions undertaken by you to be settled before your Digital IGA Rewards Visa Card can be closed. As soon as you notify us that you wish to close the Digital IGA Rewards Visa Card you will no longer be able to use your Digital IGA Rewards Visa Card.

You will remain liable for any transactions that were not processed, or that occur, on your Digital IGA Rewards Visa Card (including, but not limited to, outstanding Merchant purchases) at the time the Digital IGA Rewards Visa Card is closed.

Once we are satisfied that all outstanding transactions have been presented and settled, we will close your Digital IGA Rewards Visa Card. Any IGA Cash remaining in your Account will be forfeited and will not be refunded, so you should try to use all of the Available Funds in your Account before you request that your Digital IGA Rewards Visa Card be closed.

The Digital IGA Rewards Visa Card will expire after 3 years and will be renewed every 3 years if the Account is active.

If the Account has been inactive for 3 years (meaning there has been no activity on your IGA Rewards account, by way of swipes or scans of the Membership Card for eligible transactions under these terms and conditions and no logins to your IGA Rewards account, during the 3-year period), the Account will be deemed inactive and you will forfeit any accrued IGA Cash / Available Balance.

We are not responsible for things outside of our control with respect to the Digital IGA Rewards Visa Card, such as:

  • where a Merchant does not accept your card;
  • delays or interruptions not caused by us;
  • transactions not being able to be processed, despite us taking reasonable precautions;
  • a dispute between you and the supplier of goods or services purchased with the Digital IGA Rewards Visa Card.

Card linking and split payments

Linking of your bank-issued credit or debit card is not required to participate in IGA Cash Back but you may consent to do so for your convenience.

You can link your bank-issued credit or debit card to your IGA Rewards account in the IGA Rewards App to facilitate split payments when using IGA Cash Back rewards. If you link your bank-issued credit or debit card and you make a purchase that exceeds your available IGA Cash Back balance on your Digital IGA Rewards Visa Card, we will automatically calculate the split between the available balance on your Digital IGA Rewards Visa Card and the amount to be charged to your linked card and process the transaction by charging the calculated amounts to each card. This will be treated as a single transaction and you will receive a single proof of purchase / receipt. Refer to the IGA Rewards privacy policy (https://igarewards.com.au/privacy) on how your linked card and other personal information is stored and used.

Involvement of Third Parties

We work with a number of third parties to provide the IGA Cash Back program. Refer to the IGA Rewards privacy policy (https://igarewards.com.au/privacy) on such third party involvement where this relates to personal information.

In-store member deals

In-store member deals will include discounts and savings on selected products from time to time that are made available to Program members only. Product deals, special offers and other benefits are determined by us or participating IGA retailers in our discretion and vary from time to time. We have no obligation to you to make available any deals or offers in any particular period or at all. Availability of member deals depends on participation by an IGA store and stock availability at the participating IGA store. You should be aware that participating IGA stores may not stock all products or varieties for which member deals are promoted or have available particular products or varieties at all times.

When you register on the Site or the App, you will be asked to select a participating IGA store as your ‘home’ store based on the closest participating store to your location. Offers will be personalised to you based on that selected store. If you wish to see offers for you for another participating IGA store, you can select a different participating IGA store on the Site or in the App.

Automatic electronic prize draw entry for members

Automatic electronic entry to selected Program prize draws (Promotions) is another key benefit of the Program for shoppers who scan their Membership Card at a participating IGA store during the relevant Promotion period and otherwise meet the eligibility requirements of the Promotion. Details of current Promotions, including the prize, any eligibility requirements (such as qualifying spend) and the specific terms and conditions of the Promotion will be available on the Site during the relevant Promotion period and will be emailed to you prior to commencement of the Promotion. You agree that if you scan your Membership Card during the relevant Promotion period and otherwise meet the Promotion eligibility requirements, you will automatically be entered into the Promotion. Promotions are subject to the following general promotional terms and conditions, as well as any Promotion-specific terms and conditions (which will prevail if there is any inconsistency):

The Promoter is Metcash Trading Limited ACN 112 073 480, unless otherwise stated.

The Promotion commences and ends on the dates specified by the Promoter (Promotional Period). Details of when, where and how the draw will take place, prizes and other Promotion-specific details (e.g. eligibility requirements) will also be specified by the Promoter.

Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

Information on how to enter and prizes notified to you by the Promoter, including additional Promotion terms and conditions notified to you via email and/or on the Site, form part of the Promotion conditions. Examples of situations where additional terms and conditions may apply include where the Promotion or prize involves travel or adventurous activities, alcoholic beverages and third party-supplied prizes.

Entry is open to residents of all states and territories of Australia, unless otherwise stated. Employees (and their immediate family members) of: participating IGA retailers; agencies/companies directly associated with the conduct of the Promotion, including those involved in managing the Promotion or determining winner/s for the Promotion; any organisation benefitting from the Promotion; Promoter and its distributors, suppliers, subsidiary companies/businesses, and any associated companies and agencies, are not eligible to enter. “Immediate family member” means any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

To be eligible for entry into the Promotion, entrants must, during the relevant Promotional Period:

  • Be a registered and subscribed member of the Program; and
  • Scan their Membership Card when making a qualifying transaction at a participating IGA Store. (Please note that certain products, as described in the Promotion-specific terms, will not be taken into account in calculating any qualifying spend for Promotion purposes).

Members receive one entry per qualifying transaction and a limit applies of a maximum three entries per person per day (or as otherwise provided in the Promotion-specific terms and conditions).

Each winner will be notified using the contact details linked to their Program account as further described in the Promotion-specific terms. All reasonable attempts will be made to contact the winner.  The prize will be awarded to the person named in the entry (e.g. the Member named on a Membership Card scanned to enter the Promotion) and any entry that is made on behalf of an entrant or by a third party will be invalid.

No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter. Unless otherwise specified, a prize cannot be separated into separate parts, events or components.

If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable at the time stipulated by the Promoter for travel (if relevant), then they forfeit the prize and the Promoter is not obliged to substitute the prize.

The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.

Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these general promotional terms and conditions or any Promotion-specific terms restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

You have certain rights under the Australian Consumer Law which cannot be excluded. However, you agree that the Promoter and its associated agencies and companies will not be liable for any loss or damage which is suffered or sustained in connection with a Promotion other than with respect to your rights under the Australian Consumer Law or to the extent that they have caused or contributed to such loss or damage.

If for any reason any aspect of a Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

If a prize (or any part of a prize) becomes unavailable, the Promoter may substitute that prize (or the relevant part of the prize) with a prize of equal or greater value and specification.

The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrants’ details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

The Promoter reserves the right to disqualify entries in the event of non-compliance with any Promotion conditions of entry (including these conditions). In the event that there is a dispute concerning the conduct of a Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.

Entrants’ personal information will be collected by the Promoter. Personal Information will be stored in the Promoter’s database.  The Promoter collects personal information about entrants to enable them to participate in Promotions and may disclose entrants’ personal information to third parties, including its contractors and agents, prize suppliers and service providers to assist in conducting the Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation.  The Promoter may also use personal information provided for future marketing purposes relating to its products, services and programs, including to contact you electronically or by phone.  The Promoter will handle the personal information in accordance with its privacy policy, which is located at https://igarewards.com.au/privacy. If you do not provide your personal information as required when entering a Promotion, you may be ineligible to enter the Promotion or claim a prize in the Promotion.

Winner(s) of any Promotion must participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed. Winner(s) acknowledge that the Promoter may use any such marketing and editorial material without further reference or compensation to them. For the purpose of public statements and advertisements, the Promoter will only publish the winner’s surname, initial and State/Territory or postcode of residence.

The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to a prize or acceptance of a prize.

Failure by the Promoter to enforce any of its rights under any Promotion conditions of entry at any stage does not constitute a waiver of those rights.

Opting out of targeted marketing communications 

A key benefit of the Program is that you will receive targeted marketing communications, including via the contact details you provide us. You can opt out of receiving email marketing communications at any time by using the unsubscribe function in the emails or by contacting us at privacy@igarewards.com.au. However, when you opt out of receiving email marketing communications, you will also cease to be eligible for automatic prize draw entry to Promotions. You should also be aware that even if you choose to opt out of direct marketing communications, we may still share content with you that we think you might find interesting online via various digital technologies (e.g. through targeted ads on your social media accounts or websites you visit).  Please see the “Digital Technologies” section of our privacy policy (at www.igarewards.com.au/privacy) for more information about how this kind of online behavioural advertising works, and steps you can take to control the tailored advertising you see online.

Access to third party offers

Another benefit of the Program is that you may access member-exclusive offers for third party goods or services. Details of those offers will be available on the Site and the App and may be included in Program marketing communications. These offers will vary from time to time, and we make no commitment regarding the ongoing availability of any offers. Members may accept those offers by contacting the third party provider directly. Any agreement for the provision of goods and services will be entered into directly by the member and the third party (or its nominee). You are responsible for evaluating whether you want to access those third party offers and you should review any applicable terms or policies of that third party.

Other member rewards and benefits

Any other member rewards or benefits which we offer from time to time will be published on the Site and in the App.

Lost, damaged or stolen Membership Cards

If you have a physical Membership Card, you can also access your Membership Card via your IGA Rewards member account on the Site or in the App (for example, if your physical Membership Card is damaged). If you notify us that a Membership Card has been lost or stolen we reserve the right to suspend or cancel the relevant account, and in such case you can contact the IGA Rewards support team for the re-provisioning of a Membership Card to you.

Changes to / Cessation of the Program

We are under no obligation to continue to offer the Program, generally or for the IGA store you have selected from time to time as your ‘home’ store. We reserve the right to change the Program (including Program benefits) at any time. We will give you reasonable notice, including by posting on the Site, the App and/or via email, of any change to the Program prior to those changes coming into effect. If you do not accept changes to the Terms, you can cancel your membership (see “Leaving the Program” below).

Disputes or complaints in relation to the Program

We have dispute resolution procedures in place to receive, investigate and resolve complaints relating to this Program. If you have a complaint, please use the Contact Us form on the Site or in the App to raise your complaint.

Leaving the Program

You can choose to leave the Program at any time. You may cancel your membership by using the “Contact us” form on the Site or App or by any other account-closure method we may make available from time to time. If you cancel your membership, or your membership is terminated by us in accordance with these Terms, you will not be eligible to receive Program member benefits and any pending benefits not already received by you will be automatically forfeited. Any IGA Cash (including any value on a Digital IGA Rewards Visa Card) will also be forfeited on cancellation or termination of your membership. If you used your membership of the Program to accept a third party offer, your agreement with that third party will remain subject to its own terms.

Third parties and our liability

While we own the Program, we have third parties that help us operate it and selected businesses and organisations that we may promote through the Program. You acknowledge that we, our related bodies corporate, IGA retailers and our third party service providers will handle your data. If you are also a member of a Third Party Program, the operator of that Third Party Program may also use your data in accordance with its own terms and conditions and privacy policy. We may receive data from the Third Party Program provider, and may also provide your data to them in connection with our administration of the Program and to enable your enrolment in their program (see under “Third Party Programs” for more information). You also acknowledge that third party offers that may be made as part of the Program are made on behalf of those third parties and that we are not responsible for providing and do not endorse those third parties or third party offers. Metcash is not responsible for any agreement you subsequently enter into with a third party as a result of a third party offer. Consumer protection legislation may confer rights and remedies on you which cannot be excluded, restricted or modified (Non-excludable Rights). Nothing in these terms and conditions is intended to exclude, restrict or modify your Non-excludable Rights. Nevertheless, to the maximum extent permitted by applicable law, you agree that we will not be liable to you for any loss, damage, cost or expense you may suffer:

  • due to IGA retailers’ and other Program participants’ conduct, representations, products and/or services, except to the extent we or our associated agencies and companies have caused or contributed to such loss, damage, cost or expense;
  • due to events beyond our reasonable control;
  • in connection with the Program, the Site or the App, except to the extent we or our associated agencies and companies have caused or contributed to such loss, damage, cost or expense; or
  • as a result of the suspension or termination of your account in accordance with these terms.

Disclaimer

Subject to your Non-excludable Rights, we do not warrant or represent that the functions contained on the Site or App will be uninterrupted and do not warrant that the Site or the App or their servers are free of computer viruses, bugs or other harmful components. Unless otherwise noted, all materials on the Site and the App are protected as copyright, trade names, trade marks or are other intellectual property owned by us and/or our affiliates or by other parties that have licensed their material or trade marks to us. Other than viewing and downloading content from the Site or the App for purposes permitted on the Site or the App (as applicable), you do not have the right to use these intellectual property rights without the written permission of their owner. You agree that you will not use the Site or the App for any unlawful or improper purpose. You will not violate or attempt to violate the security of the Site or the App. All rights not expressly granted are reserved. Links may be included on the Site or the App which will allow you to connect with sites that are not under our control. We provide these links only as a convenience. The appearance of a link does not imply our endorsement, nor are we responsible for the contents of any linked site. You access them at your own risk. You should carefully review the terms of use and privacy policies of all external websites that you visit.

General

This document is governed by and construed in accordance with the laws of New South Wales, Australia. These terms and conditions supersede any and all prior terms and conditions where notice has been provided pursuant to these terms and conditions. If any provision of these terms and conditions is found to be unenforceable under New South Wales law, this will not affect the remainder of the provisions of these Terms, which will remain in full force and effect. A failure to enforce any right or provision of these terms and conditions will not restrict either you or us from enforcing that right or provision now or in future.
